Several New Mexico businesses have filed a federal lawsuit to nullify the governor’s emergency health order, contending the coronavirus is no worse than the seasonal flu and doesn’t justify stay-at-home restrictions or even a mask mandate.

The lawsuit names Gov. Michelle Lujan Grisham and the state Department of Health, arguing they imposed arbitrary and unnecessary rules for a contagion that should not be deemed an emergency. It asks the U.S. District Court to override the governor’s executive orders.

“All the various restrictions that have been placed would be null and void if there’s no emergency,” said Ana Garner, a Santa Fe attorney who is one of three lawyers representing the plaintiffs.

The lawsuit is the most recent attempt to challenge the governor’s emergency health orders, aimed at curbing the virus spread amid a pandemic that has besieged state and national economies.

The state Supreme Court has backed the governor’s authority to restrict commercial and public activities in the pandemic.

Governor’s Office spokesman Tripp Stelnicki said his office won’t comment on pending litigation.

But Matt Bieber, Health Department spokesman, said the lawsuit seems to overlook some grim facts about COVID-19, noting more 2,400 deaths in New Mexico alone.

“The medical profession is clear: This is the worst global pandemic in a century,” he said. “The lawsuit appears to be out of step with these realities.”

Aside from requesting that the court overturn the governor’s order, the 125-page lawsuit seeks to limit any future public health orders to “an extremely limited period of time” unless authorized by the Legislature.

It also asks the plaintiffs be compensated for lost income during the lockdowns. They include three Albuquerque businesses, a Silver City restaurant and a number of individuals.



The lawsuit contends the precautionary measures the governor imposed are out of proportion to the virus’s true severity, which it says could have a mortality rate as low as 0.14 percent. That’s in sharp contrast to latest national figures that have more than 335,000 Americans dying out of 19.4 million cases — a 1.7 percent fatality rate.

It cites the widely challenged assertion that most patients die from co-morbidities — or underlying health problems — and not from the virus itself.

“We’re saying it’s roughly equivalent to seasonal flu,” Garner said.

Garner said lawyers cited 325 references in the lawsuit, arguing “there is a lot of science behind it.”

The lawsuit also challenges the effectiveness of face masks and claims they impede the breathing not only of those with respiratory problems but people living at higher elevations where oxygen is thinner.

It also claims state health officials have overestimated asymptomatic transmission, and that people with COVID-19 symptoms should be targeted for restrictions and mask-wearing.

These assertions run counter to the Centers for Disease Control and Prevention, the National Institutes of Health and Johns Hopkins University, which say masks curb spread and asymptomatic carriers are highly contagious.

The lawsuit goes on to accuse the state of violating New Mexicans’ constitutional rights to gather, including at places of worship. It argues that past court rulings bar the needs of a minority segment — in this case, those who are most vulnerable to the virus — to override the rights of the majority.

The court should declare on the record that the restrictions are unconstitutional, the lawsuit says.

“While we recognize that there may on occasion be a legitimate public health emergency … allowing for an unending declaration of emergency without a check on such power is completely unconstitutional,” the lawsuit says.

I support this class action fully. I may not agree with everything, however this quarantine has gone on too long and most importantly it is their constitutional right to be heard by higher courts. Other states that opened up fared far better in this pandemic. Look at our statistics. We waited to have the surge during the holidays instead of earlier. We knew this was coming. Instead of focusing on the most vunerable populations our government induced wide spread hysteria and enforced rules that have clearly failed. Our governor made a mistake. She may have had good intentions, but she also needs to admit them and let us move on. I know some of these businesses, and in particular Blackman's is an awesome business and is one of the biggest donors to our school's PTA. They even offered discounts during the quarantine to keep our kids active and healthy with online classes. And Jalisco's is really one of the best Mexican restaurants in the Southwest. Their chips and salsa have no equal in my opinion. Good luck small businesses that are willing to take a stand for your rights!

well, if you use the veterans home as an excuse to shut down people in a county, then have it spread like crazy through the vets home and have to remove incompetent state management, then the governor has failed miserably. As a result of those workers and residents spread, she shuts down restaurants miles away. If she coordinated an effort to remove and separate to a different facility the positive people so they could not spread it to all, then she would have actually have done something. But, she didn't. In another state almost all patients in the memory care wing of my mom's facility caught it as it spread through. shutting down restaurants does not protect my mom in assisted living. testing and replacing/rotating out the positive workers and residents might actually decontaminate the facility and save lives. Why is there no removing the positive residents to a separate facility short time ? that is what would actually save lives. too bad no one directing the shut downs in this country does it. The total lack of ingenuity and work arounds implemented in this country has been shameful.

I think medical people are most afraid about overloading the medical system. That means more sickos than equipment, beds and personnel. Those states have no where to put the sick people. Those people probably got virus weeks ago, when all these states did not have lockdowns. We are heading into Jan, 2021, how come New Mexico is still a red state? Any conclusions as to why this Governor still hasn't turned this state around?

Thus the mortality rate is closer to 0.2% Another study in the SF Bay area showed a mortality rate of between 0.1 and 0.25%. Please use accurate scientific data.

How many people need to die for some folks to finally stop playing politics with this tragedy? We have already lost nearly 340,000 lives, our healthcare system is on the brink of collapsing in many parts of the country, many thousands of people have long term health consequences from these infections (some have even required lung transplants), etc. I applaud our governor for following the science and doing what she has to do to avoid more unnecessary loss of life, keep our hospitals from being overwhelmed, and protect our health. Rather than tie up our courts with more frivolous law suits in an attempt to smear our governor, these folks should invest their efforts in getting people to comply with what the CDC and all the infectious disease experts are telling us to do: stay away from groups of people whenever possible, when you cannot, wear a mask and keep a safe distance from others....it really isn’t that onerous.

That said, I believe we need to provide far more economic aid for business owners until we can get folks vaccinated and get the economy rolling again. One major overriding factor seems to be overlooked in this article - what about overwhelming the healthcare system? What about hospital resources? Staff? people should be treated.. not just sent home and told to come back when they are dying .. people who receive treatments recover just look at the politicians who use public money to get early vaccinations and treatment.. some doctors have stepped up and started treating people and they are having great success .. its real but not as deadly as they say..

Finally we ask the courts to look at the science. Unlike governor's office, which does NOT show the science, this much needed lawsuit does. I've read the lawsuit, have you? Maybe, just maybe you read it before you keep swallowing the complete lack of science from the governor's office. Ask the governor's office...died from covid or with covid? Number of flu deaths this year? Which study shows asymptomatic spread? They won't answer! I've read the science on masks, National Institute of Health, cotton masks are ONE time, SHORT use....anyone following that? Of course as long as you get your science from the State you will remain ignorant. Read the lawsuit and the science within, then comment otherwise you look like a dupe of the State.
