Developer: County’s delay of project violates legal settlement

Eldorado-area developer Joe Miller says Santa Fe County’s failure to take action on a land-use proposal he submitted on March 12 violates a legal settlement he reached with the county last year.

Miller has tried for several decades to develop property he owns along the U.S. 285 corridor near Lamy. But his projects have been delayed for the better part of the last 20 years by various factors — including a decadelong moratorium on development in the area due to water issues and his ongoing legal battle with Santa Fe County over the the county’s affordable-housing rules.

    Joe Miller's, Spirit Wind West development, is just the start of his plans to add many homes in the 285, Eldorado area.

    Mr Miller's representatives have said that they have talked to the area's neighbors, but this is not true. His representatives have only met with one group of neighbors.There is another group of neighbors directly adjacent to the first phase of Mr. Millers proposed development that he has never spoken to! He has said that he has an agreement with the County to develop his land. This agreement was reached according to his own his words by, "dropping law-suits against the County." What kind of agreement is that? Mr Miller's way of developing, is to sue? Mr Miller's proposed development has a supposed open space and a park plan. The trail plan was turned down by the County because it did not meet their minimum requirements. His proposed park was located in a big arroyo, not suitable for any kind of use.

    Why do we need to develop, and develop? Just because developers want to? We have a surplus of lots, and homes all around the area that sit vacant now.

    The water issue also could cause problems down the road, especially if this drought continues.

    I do not have a problem with the right of Mr Miller to develop his land. I feel he has that right, if it keeps with the standards that already exist in the community. What I really protest to, is Mr Miller's way of suing and threatening to open a "pig farm," to get his way. He is sounding like a bully and not someone who has the community's best interest in mind.

    Unless you live in the Lamy/Eldorado area and have some idea of the situation with Mr Miller, and his proposed new development(s), it might be easy to subject Ms Holians comments to ridicule?
    The articles written on this are disingenuous at best. Mr Miller has agreed to only a small percentage, actually 1 only modification, that I am aware of at this writng. Also, Mr Miller's development is not "across the road from Spirit Wind", it is literally commingled with it. Ms. Holian and the rest of the board, as I understand it, are the last and final arbiters of building development in our county. As such, I believe they are trying to protect the presently existing community, from several things, amongst them are, water over usage, environmental damage, economic damage, among them. Also, Mr Miller's Spirit Wind development is just the tip of his iceberg. He has at least 1 more in the works in Eldorado, if not 2? Spirit Wind being given the go ahead, would set a precedent for the others, which are larger, similarly configured, ie, lo cost modular homes and mobiles, few covenants...develop, plat, sell, run?
    Mr Miller has satisfied code requirements in these. However, according to the county attorney, codes are being rewritten. At the least, why cannot Mr Miller's developments be judged by this new set of codes, which may reflect some of Ms Holians comments...codified.?
    Mr Miller has permits for water for Spirit Wind and the state ostensibly has given its go ahead on quantities needed and plenty of reserve supplies left for the rest of us. OK, but how do they know this? We are entering the 4th year of drought conditions, and this does not look like it is ending anytime soon, rather, no water may be becoming our new reality? Why exacerbate the situation by adding several million gallons a month to an already rationed system? Just does not make sense to me. Perhaps someone can stand up, at least in the media, and tell us not to worry, that an additional 118 homes in the Lamy/ Eldorado area have plenty of water, as well as the existing users, and than guarantee that.
    Finally, Mr Miller is hardly being put upon. No one, Including Mr Miller, can develop willy nilly anymore in this county, or anywhere in the United States. Mr Miller is pushing his development ideas because they are, simply, Mr Millers development ideas, sans any input from the community. I agree with and defend Mr Miller's right to develop his property. But, only in a community defined responsible manner. He can show the same P and L with a responsible community development plan as he can with what he presently is attempting.
    If he wants to put in a hog farm, as he has petulantly alluded to, fine, he is directly downwind of it, folks in Spirit Wind are not. The effluent containment ponds essential and required by the gov, would never make it past the application stage given the water situation presently in NM.

    most modular homes look like a shoebox, but then so do lots of reg. houses. they can achieve a better look, if so ordered- extended garage, some 'L' shape added or some add-on.
    i used lumber inc. to build all my walls & roof trusses, saving $10k+-. (w/16 faces.) they use wholesale priced lumber & the guys don't have to get out & put away their tools every day. the factory-made sects. are made according to computer generated plans that number each wall & truss.

    There are modular homes that are much better built then the fake adobes.

    Holian says "It's not logical for moderate to low-income people to live so far from town." Really??!!! How compassionate. Why don't we just herd all of the poor people into "denser" areas in undesirable neighborhoods in the city where nobody will complain about their views being obstructed by modular homes. Poor people don't need fresh air, or views, and god forbid they should be able to make their own decisions about where they live and what they can and can't afford.
