Former Santa Fe County Sheriff Greg Solano was sentenced to one year incarceration, including three months jail time, in state District Court today.
The former sheriff pleaded guilty in July to five counts of fraud for stealing county-owned items and selling them for personal gain on eBay.
In addition to three months jail time, Solano will also be placed on electronically monitoring for nine months. Electronic monitoring is considered a form of incarceration.
Following incarceration, Solano will serve four years probation during which time he will not be allowed to gamble. Solano was not taken into custody following the proceedings, he will be allowed to report to jail next week.
At a restitution hearing last month, Judge Stephen Pfeffer ordered Solano to pay back the county $25,000. Ninth Judicial District Attorney Matt Chandler, the special prosecutor in the case, was seeking more than $130,000 in restitution and eight years jail time.
The items in the case included office supplies, cell phones and bulletproof vests, which were sold on eBay to as far back as 2004, according to New Mexico State Police and state prosecutors.
Defense attorneys Brooke Gamble and Tom Clark had made it clear they feel Solano should serve no jail time as he is working four jobs in an effort to save money and pay the restitution.
Solano said last month that he will have as much as half — about $12,000 to $13,000 — to pay toward the restitution at the time of sentencing.
In court, Solano had a check for $10,000 to pay in restitution.
