Police are holding a 52-year-old Santa Fe man who they say admitted buying a $5 bottle of brandy for a 15-year old girl before having sexual contact with her for the second time in two weeks.
Jerry Archuleta was being held without bond Wednesday night in the Santa Fe County jail without bond, charged with one count each of criminal sexual penetration, criminal sexual contact with a minor, contributing to the delinquency of a minor, false imprisonment, possession of marijuana and possession of drug paraphernalia.
A criminal complaint filed by Santa Fe Police Officer Paul Joye states Archuleta told investigators he knew the girl was 15 years old but repeatedly proclaimed he "didn't rape her," claiming the encounter was mutual, despite the fact that the girl once bit his arm and later bit his tongue when he was kissing her, drawing blood, and pushed him off her.
Archuleta told police he "got fresh" with the girl on two occasions in the past two weeks, including touching her sexually.
The document states Archuleta called the teen "just a hot little girl" and said that while he felt bad about what he was doing, "when a girl is teasing like (the teen) was, 'a man's gonna do what he has to do.' "
The police report claims Archuleta admitted to sexual contact with the girl on more than one occasion and said he even chased the girl around his house because she wanted him to. When asked by police if the girl asked him to chase her, Archuleta said no, but "he knew she wanted him to chase her."
The girl told police she went to Archuleta's house Tuesday to smoke a cigarette with a friend. When she returned later, alone, to retrieve a lighter, the girl claims Archuleta would not let her leave his house. Instead, according to the police report, Archuleta grabbed the girl, pushed her into his bedroom and began sticking his hands under her clothing.
The girl told police Archuleta held a knife to her face at one point.
Archuleta told police, according to the court document, that the girl came to his house to drink alcohol. He told police he bought himself a 40-ounce bottle of Budweiser beer to drink and bought for the girl a $5 bottle of apricot-flavored brandy. After the girl "got drunk right away," Archuleta reportedly told police, he "made a move on her."
According to the probable cause statement, the girl claims she did not tell police about a similar sexual assault at Archuleta's house two weeks ago because "Archuleta threatened to kill her grandmother if she told anyone, so she decided to keep quiet about the incident."
