Suspected flasher wanted in Vermont

Sabien E. Byrd is back in jail.

The man Santa Fe police arrested last month saying he was flashing people downtown near the Plaza was arrested Friday around 2:15 p.m. at his home and charged with being a fugitive from justice from Vermont.

Byrd, 37, was wanted for an unspecified probation violation that he had been on since 2007. The charge for which Byrd was on probation there was committing a prohibited act, a misdemeanor, according to John Murphy, public records supervisor for the Vermont Department of Corrections

While warrants for probation violations aren't usually considered worthy of putting out a national warrant for a defendant, the Vermont Department of Corrections did so in this case. Murphy said he did not have any more details on Byrd's arrest warrant or original charges.

Vermont state court records are not available online, but according to online archives for the Burlington (Vt.) Daily Press, Byrd was originally charged with a felony count of lewd and lascivious conduct on Nov. 9, 2006. That charge was "amended" to a misdemeanor charge of prohibited acts as part of a plea agreement. Byrd, who pleaded guilty to the charge, according to the newspaper, was given a nine-month suspended sentence and probation.

Santa Fe police Lt. Louis Carlos said he wasn't sure on the details of why Vermont authorities sent out a national warrant for a misdemeanor charge, but did note that detectives were aware that Byrd's original charge in that state was a felony charge.

Byrd, who was booked into the Santa Fe County jail at 3:21 p.m. Friday, is being held without bond while Vermont authorities arrange extradition back to that state.

Police say a local taxi cab driver witnessed Byrd exposing himself to a woman on Old Santa Fe Trail on Dec. 21. Investigators also say he is suspected to have done the same thing multiple times over the years, often wearing come combination of a mask, a cape and tights.

In the December instance, the tights Byrd was wearing at the time of his arrest had a hole in the crotch cut out. Police released photos of Byrd's attire at the time of his arrest to the media because his clothing, according to Carlos, was such a key part of the incident.

But state court records show Byrd has not yet been charged with indecent exposure. Rather he was only charged in December with resisting or evading an officer.

Carlos said there have been some issues with positive identification from multiple witnesses, including one minor, because Byrd often wore a mask or other pieces of clothing during his flashing incidents, which made positive facial identification impossible.

Police say they are still working with multiple alleged victims who say Byrd exposed himself to them.

It is unclear when Byrd may be extradited to Vermont.
