Notice is hereby given that on May 8, 2008 Edgewood Water Company, 5124 E. Paradise Lane, Scottsdale, AZ 85254 c/o Mike Danzer filed Application No. E-483 and E-483-S with the STATE ENGINEER for Permit to Change Place or Purpose of Use of Underground Water in the Estancia Underground Water Basin in the State of New Mexico.
The applicant proposes to change the permitted place of use currently described as: the N. Pt. SW 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; Pt. S 1/2 NW 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; N. Pt. SE 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; S. Pt. NE 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; Pt. S 1/2 S 1/2 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; N. Pt. SW 1/4 NW 1/4 of Section 19, Township 10 North, Range 8 East, N.M.P.M.; S. Pt. NW 1/4 NW 1/4 of Section 19, Township 10 North, Range 8 East, N.M.P.M.; W. Pt. The current permitted place of use is located in Santa Fe and Torrance County, and extends approximately 3 miles east of Edgewood to approximately 3 miles west of Edgewood, and from 1 mile north of Edgewood to approximately 7 miles south of Edgewood, in Torrance County and Santa Fe County, New Mexico.
The applicant proposes to change the place of use to the following locations described as: the N. Pt. SW 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; Pt. S 1/2 NW 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; N. Pt. SE 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; S. Pt. NE 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; Pt. S 1/2 S 1/2 NE 1/4 of Section 24, Township 10 North, Range 7 East, N.M.P.M.; N. Pt. SW 1/4 NW 1/4 of Section 19, Township 10 North, Range 8 East, N.M.P.M.; S. Pt. NW 1/4 NW 1/4 of Section 19, Township 10 North, Range 8 East, N.M.P.M.; W. Pt. NW 1/4 SE 1/4 NW 1/4 of Section 19, Township 10 North, Range 8 East, N.M.P.M.; W. Pt. NW 1/4 of Section 19, Township 10 North, Range 8 East, N.M.P.M.; Tract A, Tract A-1, Tract A-2, Tract B and Tract C, comprising approximately 323 acres of land generally located in the SW 1/4 of Section 7, Township 10 North, Range 8 East, N.M.P.M., and the NW 1/4 of Section 18, Township 10 North, Range 8 East, N.M.P.M.; Tract 1 of the Lands of Ada Williams, comprising approximately 219.51 acres of land generally located in the SW 1/4 of Section 19, Township 10 North, Range 8 East, N.M.P.M.; Tract B-2-A, Tract B-2 and Tract B-2-D of the Bassett Ranch Subdivision, comprising approximately 401 acres of land generally located in the W 1/2 of Section 30, Township 10 North, Range 8 East, N.M.P.M., and the NW 1/4 of Section 31, Township 10 North, Range 8 East, N.M.P.M., owned by Edgewood Developing Partners, LLC. The proposed place of use is located in Santa Fe County, and extends approximately 2 miles east of Edgewood to approximately 5 miles east and northeast of Edgewood, Santa Fe County, New Mexico.
No increase in the permitted consumptive use diversion of 178.4 acre-feet per annum for domestic, irrigation, commercial and subdivision purposes is requested by this application. Water is diverted from existing permitted well No. E-483 located within the NW 1/4 SW 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East, NMPM, and existing permitted well No. E-384-S located within the NW 1/4 SW 1/4 NE 1/4 of Section 24, Township 10 North, Range 7 East on land owned by Edgewood Developing Partners, LLC, Santa Fe County, New Mexico.
Any person or other entity shall have standing to file an objection or protest if they object that the granting of the application will: (1) Be detrimental to the objector's water right; or (2) Be contrary to the conservation of water within the state or detrimental to the public welfare of the state, provided that the objector shows how they will be substantially and specifically affected by the granting of the application.
A valid objection or protest shall set forth the grounds for asserting standing and shall be legible, signed, and include the complete mailing address of the objector. An objection or protest must be filed with the state engineer not later than 10 calendar days after the date of the last publication of this notice. An objection or protest may be mailed to the Office of the State Engineer, 121 Tijeras NE, Suite 2000, Albuquerque, NM 87102, or faxed to (505) 764-3892 provided the original is hand-delivered or postmarked within 24 hours after transmission of the fax. The State Engineer will take the application up for consideration in the most appropriate and timely manner practical.
