The applicant seeks to replace the described well with a new well, 350 feet deep, to be located within 300 feet southwest from the original well, for the continued diversion of up to 0.42 acre-foot of water per annum. The old well shall be plugged. The applicant further states that well production has declined, and water quality is less potable due to increasing iron content. The property is located 1.5 miles east of Old Las Vegas Highway on Apache Ridge Road, in Santa Fe County.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (legible, signed, and include the writer’s complete name and mailing address). The objection to the approval of the application must be based on: (1) Impairment,; if impairment you must specifically identify your water rights; and/or (2) Public welfare/conservation of water: if public welfare or conservation of water within the state of New Mexico, you must show you will be substantially affected. The written protest must be filed, in triplicate, with the Office of the State Engineer, Water Rights Division, P.O. Box 25102, Santa Fe, New Mexico, 87504-5102 within ten (10) days after the date of last publication of this Notice. Facsimiles (faxes) will be accepted as a valid protest as long as the hard copy is sent within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protest can be faxed to Office of the State Engineer, 505/827-6682. If no valid protest or objection is filed, the State Engineer will evaluate the application in the most appropriate and timely manner.

Gonzales filed a Petition for Formal Adjudication of Intestacy, for Formal Determination of Heirship, for Formal Determination of Community Character of Real Property, for Formal Probate of Will, and for Formal Appointment of Personal Representative in the above-styled and numbered matter on June 19, 2008; and,
3. A hearing on the above-referenced Petition has been set for August 05, 2008, at 8:15 a.m. at the Judge Steve Herrera Judicial Complex, 100 Catron Street (Corner of Catron Street and Grant Avenue), Santa Fe, New Mexico, before the Honorable Daniel A. Sanchez.

SANTA FE/POJOAQUE SOIL AND WATER CONSERVATION
DISTRICT
OPEN MEETINGS RESOLUTION


WHEREAS, Section 10-15-1 (B) of the Open Meetings Act (Section 10-15-1 through 10-15-4 NMSA 1978) states that, except as may be otherwise provided in the Constitution or the provisions of the Open Meeting Act, all meeting of a quorum of members of any board, commission, other policy making body of any state agency held for the purpose of formulating public policy, discussing public business or for the purpose of taking any action within the authority of such board, commission or other policy making body are declared to be publish meetings open to the public at all time; and
WHEREAS, any meeting subject to the Open Meetings Act at which the discussion or adoption of any proposed resolution, rule, regulation or formal action occurs shall be held only after reasonable notice to the public, and
WHEREAS, Section 10-15-1 B) of the Open Meetings Act required the SANTA FE/POJOAQUE Soil and Water Conservation District to determine annually what constitutes reasonable notice of its public meetings;
NOW THEREFORE BE IT RESOLVED by the SANTA FE/POJOAQUE Soil and Water Conservation District, on this 13th day of December 2007 that :
1. Regular meeting of the SANTA FE/POJOAQUE Soil and Water Conservation District shall ordinarily be held each month at 9:00 a.m. on the second Wednesday of each month at the Santa Cruz Irrigation District, 1449 Calle Dominicas, Santa Cruz, New Mexico 87567. An annual Schedule and Proposed Agenda will be available from the District office, 1911 Fifth Street, Suite 201, Santa Fe, New Mexico 87505. Notice of regular meetings will be given seven days before the meeting to parties who request it in writing.
2. Special meetings of the SANTA FE/POJOAQUE Soil and Water Conservation District may be called by the Chairman or a majority of the members upon two day notice. Parties who have requested notice of meetings in writing will be notified by telephone.
3. Special meetings of the SANTA FE/POJOAQUE Soil and Water Conservation District are meetings called under the circumstances, which demand immediate action, by the Board of Supervisors. Although the Board of Supervisors would avoid emergency meetings whenever possible, such circumstances may occasionally arise. Emergency may be called by the Chairman or a majority of the members upon 24 hour notice. Parties who have requested a notice of meetings in writing will be notified by telephone.
4. Pursuant to Section 10-15-1 (E) NMSA 1978, THE Santa Fe/Pojoaque Soil and Water Conservation District may close a meeting to the public if the subject matter of such discussion or action is included in Subsection E of the Opening Meetings Act, Section 10-15-1 NMSA 1978. If any Board of Supervisors meeting is closed pursuant to Section 10-15-1 (E) NMSA, such closure:
A. If made in an open meeting, shall be provided by a majority vote of a quorum of the Board of Supervisors and authority for the closure shall be stated in the motion calling for the vote on a closed meeting. The vote on a closed meeting shall be taken in an open meeting and the vote of each individual member is to be recorded in the minutes. Only those subject announced or voted upon prior to closure by the Board of Supervisors may be discussed in a closed meeting; and
B. If called for when the Board of Supervisors is not in an open meeting, the closed meeting shall not be held until public notice, appropriate under the circumstances, stating the specific provision of law authorizing the closed meeting is given to the members and to the general public.
5.
